BetSignal, LLC, a Georgia limited liability company and its affiliates and subsidiaries, (collectively, “we”, “us” or “our”) are committed to protecting your (“you” or “your”) privacy and abide by this privacy policy (this “Privacy Policy”). This Privacy Policy explains how we collect, use, disclose, and apply the information collected when you use or access our website and related application, formally known as BetSignal (the “Platform”). Our terms of service (the “Terms of Service”) are expressly incorporated herein by reference and are an integral part hereof.
This Privacy Policy sets forth our policy with respect to information that we collect from you, on or through the Platform, that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you (“Personal Information”). By using the Platform, or interacting with us, you are agreeing to this Privacy Policy. Please read it carefully. If you do not agree herewith, do not access or use the Platform.
1. Changes to this Policy. We may change this Privacy Policy from time to time by publication of an updated version on our websites. We encourage you to review our Privacy Policy whenever you access such websites or otherwise use the Platform.
2. What Information We Collect. We collect information about you from various sources using various methods, including as follows:
2.1 Information Provided to Us. We collect information that you provide directly to us or through the Platform and information provided to us by third party services, our affiliates, and our business partners. Information you provide to us includes:
2.1.1 Account and Profile Information. When you create an account, we collect basic information about you such as name, email address, phone number, billing information, physical address, company name, job title, and other information you input in open text fields.
2.1.2 Customer Support. When you contact us with an issue, you may provide us with a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving an issue submitted to our customer support.
2.2 Information We Collect Automatically. We receive and store certain types of information automatically, such as whenever you interact with the Platform. Information collected automatically includes:
2.2.1 Log Information. We retain information about you when you access and use the Platform. This information can include the following: IP address, timestamps, browser information, Internet Service Provider “ISP”, web pages visited, URL of the web page you visited before navigating to our websites, and device identifiers.
2.2.2 Usage Information. We monitor user activity in connection with the Platform and may collect information about the applications and features you use, Third Party Platforms you visit, as well as other usage activity.
2.2.3 Device Information. We collect device information including the IP address and other details of the device that you use to access our Platform, such as the Internet Service Provider, operating system, browser type, browser activity, timestamps, and/or mobile network information);
2.2.4 Transactional Information. We collect transactional information, including payment information and payment history if you engage in transactions with us generally. All credit card information is stored by a third-party payment processor selected by us, from time to time, and such payment services are governed by such third-party payment processor’s terms of service and privacy policy. For the avoidance of doubt, your credit card information is never stored by us.
2.2.5 User Data. As related to your receipt of services from us, you may input, upload, provide, deliver, transmit, or otherwise make available certain data, information, text, files, and other materials to us, via e-mail or any other available mechanisms, which, for the avoidance of doubt, may include certain Personal Data of the User and of other related data subjects.
2.2.6 Crash and Error Information. If the Platform crashes or makes an error, we may collect data to determine the cause of the error using first- or third-party services. The crash or error information collected may include the following: Device Internet Protocol (“IP”) address, device name, operating system version, application configurations(s), the time and date, and other statistics.
2.3 Information We Obtain from Others. We may obtain information about you from third parties who help us provide our Platform to you. We may also obtain some information from our marketing partners to inform you about products, new surveys, or Platform that we think you might be interested in. Finally, we may obtain information that does not identify you directly, but which is later used in a way that may later directly identify you. We may combine that general information with your information to provide related services to you.
3. Cookies and Other Technologies. Like many Third-Party Platforms, our websites may use “cookies” or “other technologies” (such as “pixel tags”, “web beacons”, “clear GIFs”, links in emails, JavaScript, device IDs assigned by Google or Apple, or similar technologies) to collect information and support certain features of our websites. Cookies and other technologies allow us and third parties to obtain information about your visits to our websites, including analyzing your visiting patterns. Although you are not required to accept cookies when you visit our websites, you may be unable to use all the functionality of our websites if your browser restricts our cookies. We use this information to process your requests and to deliver online and mobile advertisements, messages and content for us and others that are specific to your interests. The information we collect from your web browser and from cookies and other technologies does not identify you personally but in some cases, we may link it to personally identifiable information.
3.1 Cookies. Below, we explain the different types of cookies that may be used on the Platform.
3.1.1 Necessary Cookies. Necessary cookies are essential to enable your use of the Platform, such as assisting with your account login, so we can show you the appropriate experience and features such as your account information, transaction history and other account settings. They may also provide authentication and site security.
3.1.2 Preference Cookies. Performance cookies are used to remember your settings and preferences, and to improve your experience on our Platform.
3.1.3 Session Cookies. Session cookies are stored only temporarily during a browsing session and are deleted from your device when you close the browser. We use session cookies to support the functionality of our websites and to understand your use of thereof, which pages you visit, which links you use and how long you stay on each page.
3.1.4 Analytics Cookies. Analytics cookies help collect information about your use of our websites and enable us to improve the way it works. These cookies give us aggregated information that we use to monitor site performance, count page visits, spot technical errors, see how users reach the websites, and measure the effectiveness of marketing (including emails).
3.1.5 Marketing Cookies. Marketing cookies are used to show users display advertisements across websites such as those on Facebook, LinkedIn, Twitter, or the general web. The intent is to display ads that are relevant and engaging for the individual user and thereby more valuable for publishers and third-party advertisers.
3.1.6 Unclassified Cookies. Unclassified cookies are cookies that we are in the process of classifying, together with the providers of individual cookies.
3.2 Other Technologies. In addition to Cookies, we may use other similar technologies, like pixel tags (also known as web beacons and clear GIFs), to, among other things, track the actions of users of the Platform (about usage including email recipients), measure the success of our marketing campaigns, and compile statistics of the Platform and response rates.
4. How We Use Your Information.
(a) We may use the information collected for the limited purpose of providing the Platform and related functionality and services, as described in this Privacy Policy and as permitted by applicable laws. These limited purposes include circumstances where it is necessary to provide or fulfill Platform requested by or for you or where you have given us your express consent. We may use the information we obtain about you to:
provide the information, products, and services you request;
provide effective customer service;
provide you with a personalized experience when you use our Platform;
contact you with special offers, newsletters, and other information we believe will be of interest to you (in accordance with any privacy preferences you have expressed to us) regarding our Platform;
invite you to participate in surveys and provide us with feedback (in accordance with any privacy preferences you have expressed to us);
improve our products and services and develop new products and services;
improve our marketing and promotional efforts;
improve the content, functionality, and usability of our websites;
enforce our Terms of Service;
promote security and protect against and prevent fraud, claims and other liabilities;
meet our internal and external audit obligations;
comply with legal obligations and legal process and protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties; and
any other purpose for which we provide notice at the time of collection.
(b) We may aggregate and/or de-identify information collected through the Platform and from other sources so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including without limitation for research and marketing purposes, and we may also share such data with any third parties, including advertisers, promotional partners, business and channel partners, and/or others.
5. How We Share and Disclose Information.
(a) We do not sell or otherwise disclose Personal Information we collect about you, except as described herein or otherwise disclosed to you at the time the data is collected. We share information to perform activities that you request. We may share the Personal Information we collect with our affiliates and business partners and to cooperate with an authorized law enforcement or regulatory investigation. We may share Personal Information with our third-party service providers for the following non-exhaustive list of purposes: billing, accounting, sales, marketing, advertising, analytics, research, internal testing for new/potential service offerings, affiliate marketing, customer relationship management, customer service, data storage, security, fraud prevention, payment processing, and legal services. In addition, we may share Personal Information with other third parties with the consent of the individual to whom the information pertains.
(b) We may also disclose information about you when we, in good faith, believe disclosure is appropriate to comply with the law, a court order, or a subpoena. We may also disclose information about you to prevent or investigate a possible crime, such as fraud or identity theft; to protect the security of our website; to enforce or apply our Terms of Service or other agreements; or to protect our own rights or property or the rights, property or safety of our users or others. We will attempt to notify users about legal demands for their Personal Information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority
(c) We also reserve the right to transfer information about you to a successor organization if we transfer the ownership or operation of one of our websites to another organization or if we merge with another organization. If such a transfer occurs, we will use reasonable efforts to direct the transferee to use Personal Information you have provided to us in a manner consistent with this policy. Following such a sale or transfer, you may contact the entity to which we transferred your Personal Information with any inquiries concerning the processing of that information.
(d) You acknowledge that your User Data, as defined in the Terms of Service, uploaded for such purposes will be shared with other users of the Platform to fulfill the purpose of the Platform. You acknowledge that we have no control over the use of your User Data by such other users and hold us harmless from all claims and damages arising from such use by other users of the Platform. Without limitation, you acknowledge that another user may interfere with the Platform to gain unfettered access to your User Data, and that other users may record or take photos of or otherwise record your User Data using other methods, and that we shall have no responsibility for such actions.
6. Your Choices.
(a) We offer you the choice in receiving communications from us, generally by offering an “opt in” or an “opt out” option, depending on applicable law, when you provide contact information through one of our websites. Additionally, we include an “unsubscribe” link in our electronic newsletters or promotional emails. These options allow you to inform us on how you want to receive communications.
(b) You may opt out of behaviorally targeted ads anytime by clearing your cache of your browser’s cookies. Additionally, you may opt-out of interest-based advertising from some third-party partners by visiting http://preferences-mgr.truste.com/, http://www.youronlinechoices.eu, or the third-party provider’s websites. Please note that opting-out will only prevent targeted ads so you may continue to see generic (non-targeted ads) after you opt-out.
(c) We may also obtain information from third parties and combine with information we collect through the Platform. We may have access to certain information from a third-party social media service if you create or log into your online account through the services or otherwise provide us with access to information from the service. Any access that we may have to such information from a third-party social media service is in accordance with the privacy policy and authorization procedures determined by the social media service. We protect data obtained from third parties according to the practices described in this Privacy Policy, plus any additional restrictions imposed by the other sources of the data.
(d) Some browsers offer a “do not track” (“DNT”) option. Since no common industry or legal standard for DNT has been adopted by industry groups, technology companies or regulators, we do not respond to DNT signals. We will make efforts to continue to monitor developments around DNT browser technology and the implementation of standards.
7. No Sensitive Data. Unless you are a Customer actively receiving services from us and such is specifically required or requested by us in in our provision of certain services to you, you agree to not upload, transmit, disclose, provide or make available to us, in any manner or form, any Sensitive Data (as defined below), and you agree and acknowledge that we will have no liability whatsoever for such Sensitive Data erroneously uploaded, transmitted, disclosed, provided or made available to us. For the purposes of this Privacy Policy, "Sensitive Data” means any Personal Data that requires a heightened degree of protection by applicable law. Sensitive Data includes, but is not limited to, social security numbers or other government-issued identification numbers, financial account numbers, geolocation, credit card or debit card numbers, CVVs, credit report information, health or medical information, or other information that is subject to international, federal, state, or local laws or regulations now or hereafter enacted requiring heightened standards for data protection or privacy, including, but not limited to, the Health Insurance Portability and Accountability Act, the Health Information Technology for Economic and Clinical Health Act, the Fair Credit Reporting Act, the Children’s Online Privacy Protection Act, and the Gramm-Leach-Bliley Act.
8. Data Processing and Data Transfers. By accessing or using the Platform or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries and territories, which may have different privacy laws from your country of residence. Personal Information collected within the European Economic Area may, for example, be transferred to and processed by third parties located in a country outside of the European Economic Area. In such instances, we shall ensure that the transfer of your Personal Information is carried out in accordance with applicable privacy laws and that appropriate contractual, technical, and organizational measures are in place.
9. Security. We take security seriously and have implemented administrative, physical, and technological measures to protect your information from unauthorized access, loss, misuse, disclosure, alteration and destruction. If you wish to report a security concern or if you have a question around security, please submit your inquiry to us in accordance with the “Contact Us” section.
10. European and Brazilian Residents. If you are a resident of the European Economic Area or Brazil, you have certain rights regarding the Personal Information we maintain about you. We offer you certain choices about what Personal Information we collect from you, how we use that information, and how we communicate with you. If at any time you wish to exercise your rights, please reach out to us in accordance with the “Contact Us” section:
10.1 Information and Access. You can request to see which Personal Information we process from you. We can inform you how and why we process this data unless restricted by law, or if we are unable to verify your identity.
10.2 Submitting Information. You may refrain from submitting information directly to us, although doing so may impact our ability to provide the services, and information you request and/or affect your ability to use the Platform
10.3 Rectification. You may request to update or correct the Personal Information we maintain for you.
10.4 Right to be Forgotten/Request Deletion. You may request deletion of your Personal Information. We may ask you for additional information to verify your identity and will process your request subject to and in accordance with the law.
10.5 Restriction. You may request the limitation on the processing of your Personal Information.
10.6 Restricting Cookies. You may elect not to have a unique cookie identification number assigned to your computer to avoid aggregation and analysis of data collected on our websites. Generally, if you do not wish to receive cookies, you may set your browser to deny cookies or to alert you when a cookie is placed on your computer.
10.7 Objection. You may remove your consent for the processing of your Personal Information.
10.8 Transferability. You may request to transfer your Personal Information.
11. Canadian Residents. If you are a resident of Canada, you may have certain rights regarding the Personal Information we maintain about you. We offer you certain choices about what Personal Information we collect from you, how we use that information, and how we communicate with you. If at any time you wish to exercise your rights, please reach out to us in accordance with the “Contact Us” section:
11.1 Information and Access. You can request to see which Personal Information we hold about and process from you. We can inform you how we use or disclose, why we use or disclose, and to whom we disclose this data unless restricted by law, or if we are unable to verify your identity.
11.2 Rectification. You may request that we correct or update any Personal Information that is inaccurate, incomplete, or outdated.
11.3 Objection. Where we rely on your consent to process your Personal Information, you may withdraw such consent at any time, subject to legal or contractual restrictions.
11.4 Challenging Compliance. You may submit to us a challenge concerning our compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) as related to our handing of your Personal Data.
11.5 Compliant. If you are not satisfied with how we handle your privacy request, you may file a complaint with the Office of the Privacy Commissioner of Canada (OPC) at www.priv.gc.ca.
12. Additional Information for Residents of Certain U.S. States. If you are a U.S. resident, we process your Personal Information in accordance with applicable U.S. state data privacy laws. Depending on where you live (including California, Colorado, Connecticut, Oregon, Nevada, Utah, Virginia, Washington, etc.), you may be entitled to certain rights with respect to your Personal Information, as further described in Exhibit A.
13. Personal Information Retention. We will retain information required to comply with privacy requests, manage active accounts, as required by law, to resolve disputes, or enforce our agreements. We may also retain copies of your information for disaster recovery purposes.
14. Links to Third Party Platforms. The Platform may contain links to other websites not operated or controlled by us, including social media services (“Third Party Platforms”). The information that you share with Third Party Platforms will be governed by the specific privacy policies and terms of service of the Third-Party Platforms and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these websites. Please contact the Third-Party Platforms directly for information on their privacy practices and policies.
15. Privacy of Children. We are committed to protecting the privacy of children and following all laws, regulations and guidelines in respect thereof. We do not knowingly accept or solicit Personal Information from a user known to be under the age of eighteen (18).
